Terms of use

In short

  • ExpoCards is a tool. You check what it reads, and you are responsible for how you use other people's contact details.
  • Your contacts live on your device. If you use Teams, our server also keeps an encrypted copy of your team's list, which we cannot read. We cannot restore your contacts, so keep a backup.
  • Teams is optional. Any member can leave a team, or delete it for everyone, at any time.
  • The AI summaries and About their company are optional and run only when you tap them. Check what they say before you rely on it.
  • Limits only ever apply to new scans. Export is always free.
  • If you are a consumer, nothing here takes away rights the law gives you.

1. Who we are and what these terms cover

ExpoCards is published by Adam Michel Monir Hakim Ayad, an individual developer based in the United Kingdom (“we”, “us”). These terms cover the ExpoCards web app, the ExpoCards apps for phones and this website (together, “ExpoCards”). By using ExpoCards you agree to them. If you do not agree, please do not use it.

Our privacy policy explains what ExpoCards does with data. It is linked at the bottom of this page.

If you got the app from an app store, that store's own terms apply as well. For Apple's App Store that includes Apple's standard Licensed Application End User Licence Agreement. The store is not a party to these terms and is not responsible for ExpoCards or for supporting it.

2. Your licence to use ExpoCards

You may install and use ExpoCards to capture, manage and export business contacts, for yourself or for the business you work for. This licence is personal to you, is not exclusive and cannot be transferred, and we may withdraw it if you seriously break these terms. ExpoCards and everything in it stay ours. The contacts you capture stay yours. ExpoCards includes open-source components, which remain under their own licences.

You must not:

  • resell, rent or sublicense ExpoCards, or offer its scanning service to other people as your own;
  • use the scanning service other than through the app, for example from a script or in bulk, or try to get round scan limits or metering;
  • interfere with the service, or use it in a way that could damage it or make it worse for other people;
  • copy, modify or reverse engineer ExpoCards, except where the law gives you that right whatever these terms say.

3. Other people's data: using ExpoCards lawfully

The details on a business card belong to the person who gave it to you. You decide why and how you use them, which in data protection law makes you the “controller” of that information. You are responsible for handling it lawfully, including under the UK GDPR, the EU GDPR and any other rules that apply to you. In practice that means, for example:

  • only scanning cards you were given or are otherwise entitled to use;
  • using the details for the purpose they were given for;
  • following the rules on marketing emails, messages and calls in your country;
  • keeping the data safe, including the device it is on and any file you export;
  • answering people who ask to see, correct or delete what you hold about them.

When you scan a card we handle the photo only in order to read it for you. Our server passes it to Anthropic, whose Claude AI reads the text, the result comes back to your device, and our server does not keep the photo. In doing this we act on your behalf (as your “processor”), and Anthropic acts on ours. If you use Teams, the data-processing terms for Teams in section 5a apply to your team's shared list as well.

Data processing terms for business customers. If you use ExpoCards for a business, this part of the terms is the agreement between you (the controller) and us (the processor) that Article 28 of the UK GDPR and the EU GDPR asks for. You do not need to sign anything else.

  • What we process, and why. The photos of the cards you scan and the contact details read from them: the names, job titles, companies, phone numbers, email and postal addresses and websites of the people whose cards they are. We process them only to read each card for you and send the result back to your device, and only on your instructions: these terms, and each scan you start. If you use the AI helpers (section 5b), also the details and notes you send for a summary, and the name and website of a company you ask about, only to answer that request.
  • For how long. Only while a card is being read, a summary written or a company’s website read. Our server keeps no copy of the photo or the details once it has answered. Anthropic keeps them for a limited time under its own data-retention policy, as our privacy policy explains.
  • Confidentiality. ExpoCards is run by one person, who keeps what is processed confidential. Anyone who ever works on it with us will be bound to do the same.
  • Security. Photos and details travel only over encrypted connections, and our server stores neither. Your contact list stays on your device unless you export it, share it with a team (section 5a: encrypted on the phone, with a key we do not have) or switch on your own database.
  • Sub-processors. Vercel hosts our scanning service, and every photo passes through it. Anthropic reads the photo with its Claude AI, and writes the summaries and reads the company websites of section 5b. Upstash stores the anonymous scan counters and purchase records, never card details in a form it can read: for Teams it also stores each team's encrypted list (section 5a). Stripe takes any payment made on our website or in the Android app, and never sees card details. Vercel and Anthropic may process the photo outside the UK and the EEA, including in the United States, under the data processing terms and transfer safeguards each of them offers its customers. We will list any new or replacement sub-processor on this page before it starts, and you may object by writing to us; if we cannot resolve your objection, you may stop using the service.
  • Helping you. We help you, as far as we reasonably can, to answer people who ask to see, correct or delete their data, and with your security, breach-reporting and impact-assessment duties. We keep no card details we can read, so most requests are answered from the contacts on your device.
  • Deletion. There is no card data for us to return when you stop: we keep none we can read. A team's encrypted copy is deleted as section 5a says. On request we delete the anonymous scan counters for your account id.
  • Breaches. If we become aware of a personal data breach affecting card data we process for you, we will tell you without undue delay: on this page, and by email if you have written to us.
  • Showing that we comply. We answer in writing any reasonable question about how we meet these terms.

Only photograph business cards and similar contact material. Do not use ExpoCards for anything unlawful, and do not upload images you have no right to use. ExpoCards is a business tool and is not intended for children.

4. Check what it reads

Cards are read automatically by an AI model, and the result can contain mistakes: a wrong digit in a phone number, a name split the wrong way. ExpoCards shows you every field next to the photo so that you can check and correct it before you save. Please do. We cannot promise that any reading is accurate or complete.

5. Your contacts are stored on your device

Contacts and card photos are stored on your device. If you use Teams (section 5a), the details of the contacts on your team's list are also kept on our server, encrypted with a key we do not have. If you switch on your own database (web app only, Settings → Advanced), they are also copied to a Supabase project that you own and are responsible for. We hold no copy we can read, so we cannot recover your contacts if the device is lost, the app is removed or the browser's site data is cleared. Please use “Download backup” regularly.

5a. Teams

Teams lets the phones on a stand share one contact list. It is optional, and nothing is shared unless you start or join a team.

  • Who starts a team. A team is set up for an organisation, such as the business whose stand it is. By ticking “I’m setting this up for my organisation” you confirm that you may accept these terms for it, and you accept them, including the data-processing terms below, on its behalf.
  • What is shared. Every contact on the team's list (its details, notes, event tag and “Assign to”) and each member's chosen name reach every phone in the team. Card photos are not shared.
  • Invites. Anyone holding a live invite, as a code or a link, can join and read the list. An invite works for 24 hours and for up to 10 people; a new invite cancels the old one. Share invites only with colleagues. Any member can remove any phone; a removed phone keeps what it already has.
  • Encryption. Contacts are encrypted on the phone, with a key only the team's phones hold, before they reach our server. We keep that encrypted copy so phones can catch up; we do not have the key and cannot read it. If every phone in a team is lost, we cannot recover the list.
  • Limits. Up to 10 phones in a team, one team on each phone, and a limit on the number of shared changes a team can hold.
  • Leaving and deleting. Any member can leave, or delete the team for everyone, which erases our copy at once. A team nobody uses for 90 days is deleted automatically. None of this deletes the contacts already on a phone. A contact deleted in a team stays in the encrypted copy until the team is deleted or expires.
  • Availability. We may pause or switch off Teams, for example during an outage. Your contacts stay on each phone, and export always works.

Data-processing terms for Teams

For a team's list, the organisation is the controller and we are its processor. These terms are the contract that Article 28 of the UK GDPR and the EU GDPR requires, accepted in electronic form. We:

  • process the encrypted copy only to store it and pass it between the team's phones, on the organisation's instructions, which are these terms and its use of Teams;
  • make sure that anyone who can reach it is bound to confidentiality;
  • protect it as described above: encryption on the phone with a key we never hold, device tokens and invites stored only as hashes, and encrypted connections;
  • use Vercel (hosting) and Upstash (the database) as sub-processors. Upstash keeps the copy in the region named in our privacy policy. Where Vercel or Upstash process it outside the UK and the EEA, including in the United States, they do so under the data processing terms and transfer safeguards each of them offers its customers. We will list any new or replacement sub-processor on this page before it starts, so that the organisation can object or delete the team;
  • help the organisation answer the people on its cards as far as we can; because we cannot read the copy, it does so from its own phones;
  • tell the organisation without undue delay about any personal data breach affecting the copy: on this page, and by email if it has written to us;
  • delete the copy when the team is deleted, or 90 days after its last use;
  • answer in writing any reasonable question about how we meet these obligations, so that the organisation can show they are met.

5b. AI summaries and About their company

Summarise notes, Today’s leads and About their company are optional. Each runs only when you tap it, needs a connection, and sends only what our privacy policy lists for it: never card photos, email addresses or phone numbers. What they write is kept on your device, with the contact.

  • Check what they say. Summaries and About their company are written by an AI model. A summary can miss or misread something in your notes. About their company repeats what the company’s own website says, which can be out of date or incomplete. Check before you rely on either.
  • The company, never the person. About their company sends only the company’s name and its website address, and reads one page of that website. It does not look anyone up. Use what it tells you only to follow up the contact who gave you their card; section 3 applies to what you keep.
  • What it uses. Each helper uses scans from your allowance: the number the app shows on its button, and before your first summary or About their company. A summary or a day’s recap uses them once it is written; About their company once their website has been read, even if it says little. A helper that fails or is refused, or a website that cannot be read, uses none. All three have daily limits on each device, whatever your plan.
  • Availability. We may switch these helpers off, or change their limits or the scans they use, at any time; a change never applies to a summary or company description already made. What they have already written stays on your device.

6. Scans, and buying more

Each successful reading uses one scan. The back of a card is a second reading, and a reading that fails is not counted. ExpoCards includes free scans every month: 10 in the calendar month of your first scan, then 5 each month after that. Settings shows how many are left. When scans run out, new photos wait in the queue on your device and are read when scans are available again. The AI helpers (section 5b) use the scans the app shows on their buttons. Automatic limits on the rate of requests protect the service from abuse.

Limits apply to new scans only. Viewing, editing, searching and exporting the contacts you have is never limited and never charged for. We will not reduce the free allowance that applies to you, and we will not take away scans you already have.

In the iPhone app you can buy one-off packs of scans, which do not expire. The App Store shows the price in your own currency, and Apple takes the payment through your Apple Account, under Apple's terms. Nothing renews by itself. The web version, and the Android app downloaded from our website, offer the free scans only; a purchase made there before keeps these terms. An event pass bought there gives up to 3,000 scans (fair use) within the number of days shown, from when it was bought; once it has made its 3,000 scans, scanning carries on from your banked scans and then your free allowance, as if there were no pass. Those payments were taken by Stripe on Stripe's own pages, with VAT included where it applied; if you need an invoice for one, write to us. We never see or store your card details.

What you buy belongs to the anonymous account id held in the browser or app you bought it in. There is no sign-in, so a purchase does not move to another browser or device by itself, and clearing that browser's site data, deleting the app or using “Erase all data” removes the id. If you need a purchase moved, write to us first with the id (Settings, under “About”) or your payment receipt.

Refunds. If you change your mind within 14 days of buying, tell us: we refund you in full if you have not used the purchase, or refund the unused part of a scan pack if you have. Refunds go back to the payment method you used. Purchases made in the iPhone app are refunded by Apple: ask Apple at reportaproblem.apple.com.

If you are a consumer in the UK or the EU, you normally have a legal right to cancel an online purchase within 14 days. If you use scans during that time, we may keep a proportionate amount for what you have used. Nothing in this section affects that right, or your rights if what we supplied is faulty or not as described.

7. Availability and changes

Scanning depends on the internet, on our hosting provider and on Anthropic. We work to keep it running, but we cannot promise that it will always be available or free of faults. If scanning is unavailable, your photos wait in the queue, and everything already on your device keeps working.

We may change, improve or withdraw features. If we ever withdraw the scanning service altogether, we will say so on this website in advance where we reasonably can, the contacts on your device will remain yours to export, and we will refund paid scans and the unused part of any event pass that you have not been able to use.

We may update these terms. The current version and its date are always on this page. A change will never take away scans you have already paid for.

We may suspend or end access to the scanning service for an account id that is used to break these terms. The contacts on your device are not affected if we do.

8. Our responsibility to you

What we never exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude. If you are a consumer, nothing in these terms affects your legal rights, including your right under the Consumer Rights Act 2015 to digital content and services that are of satisfactory quality, fit for purpose and as described.

If you are a consumer. If defective digital content that we supplied damages a device or digital content belonging to you, and that happened because we failed to use reasonable care and skill, we will either repair the damage or pay you compensation. We are responsible for loss or damage that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or that you could reasonably have avoided, for example by checking a reading before relying on it or by keeping a backup.

If you use ExpoCards for business. Subject to “What we never exclude” above, we are not liable for loss of profit, loss of business or contracts, business interruption, or indirect or consequential loss, and our total liability to you for all claims is limited to the greater of £100 and the amount you paid us in the 12 months before the claim.

9. Governing law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer living in Scotland, in Northern Ireland or outside the United Kingdom, you may also bring a claim in the courts of the place where you live, and you keep the protection of any mandatory consumer law there.

Please write to us first. Most problems are solved by email.

10. Other terms

If a court finds that part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still do so later. These terms are between you and us, and nobody else has rights under them. We may transfer our rights and obligations to another person or company that takes over ExpoCards. We will say so on this page if that happens, and it will not reduce your rights.

These terms are written in English. The Spanish version is a translation for your convenience. If the two differ, the English version applies, except where the law of your country gives a consumer the right to rely on the version in their own language.

1. Quiénes somos y qué cubren estas condiciones

ExpoCards lo publica Adam Michel Monir Hakim Ayad, un desarrollador independiente establecido en el Reino Unido («nosotros»). Estas condiciones cubren la app web de ExpoCards, las apps de ExpoCards para móviles y este sitio web (en conjunto, «ExpoCards»). Al usar ExpoCards las aceptas. Si has obtenido la app en una tienda de aplicaciones, también se aplican las condiciones de esa tienda. En el caso del App Store de Apple, eso incluye el contrato de licencia de usuario final estándar de Apple para aplicaciones con licencia. La tienda no es parte de estas condiciones y no responde de ExpoCards ni de su soporte.

2. Tu licencia para usar ExpoCards

Puedes instalar y usar ExpoCards para capturar, gestionar y exportar contactos profesionales, para ti o para la empresa en la que trabajas. Esta licencia es personal, no es exclusiva y no se puede transferir, y podemos retirarla si incumples gravemente estas condiciones. ExpoCards y todo lo que contiene siguen siendo nuestros. Los contactos que captures siguen siendo tuyos. ExpoCards incluye componentes de código abierto, que se rigen por sus propias licencias.

No debes:

  • revender, alquilar ni sublicenciar ExpoCards, ni ofrecer a otras personas su servicio de escaneo como si fuera tuyo;
  • usar el servicio de escaneo de otro modo que no sea a través de la app, por ejemplo desde un script o de forma masiva, ni intentar saltarte los límites o el recuento de escaneos;
  • interferir en el servicio, ni usarlo de un modo que pueda dañarlo o empeorarlo para los demás;
  • copiar, modificar ni aplicar ingeniería inversa a ExpoCards, salvo cuando la ley te reconozca ese derecho digan lo que digan estas condiciones.

3. Los datos de otras personas: un uso conforme a la ley

Los datos de una tarjeta de visita pertenecen a la persona que te la dio. Tú decides para qué y cómo los usas, lo que, según la normativa de protección de datos, te convierte en «responsable del tratamiento» de esa información. Te corresponde tratarla conforme a la ley, incluidos el RGPD de la UE, el RGPD del Reino Unido y cualquier otra norma que te sea aplicable. En la práctica eso significa, por ejemplo:

  • escanear solo tarjetas que te hayan dado o que tengas derecho a usar por otro motivo;
  • usar los datos para la finalidad para la que te los dieron;
  • cumplir las normas de tu país sobre correos, mensajes y llamadas comerciales;
  • mantener los datos seguros, incluidos el dispositivo en el que están y cualquier archivo que exportes;
  • atender a quienes te pidan ver, corregir o borrar lo que guardas sobre ellos.

Cuando escaneas una tarjeta, tratamos la foto únicamente para leerla por ti. Nuestro servidor se la pasa a Anthropic, cuya IA Claude lee el texto, el resultado vuelve a tu dispositivo y nuestro servidor no conserva la foto. Al hacerlo actuamos por cuenta tuya (como tu «encargado del tratamiento»), y Anthropic actúa por cuenta nuestra. Si usas Equipos, a la lista compartida de tu equipo se le aplican además las condiciones de tratamiento de datos de Equipos del apartado 5a.

Condiciones de tratamiento de datos para clientes profesionales. Si usas ExpoCards para una empresa, esta parte de las condiciones es el contrato entre tú (el responsable) y nosotros (el encargado) que exige el artículo 28 del RGPD de la UE y del RGPD del Reino Unido. No necesitas firmar nada más.

  • Qué tratamos y para qué. Las fotos de las tarjetas que escaneas y los datos de contacto que se leen en ellas: los nombres, cargos, empresas, teléfonos, direcciones de correo electrónico y postales y sitios web de las personas a quienes pertenecen. Los tratamos únicamente para leer cada tarjeta por ti y devolver el resultado a tu dispositivo, y solo siguiendo tus instrucciones: estas condiciones y cada escaneo que inicias. Si usas las ayudas de IA (apartado 5b), también los datos y notas que envías para un resumen, y el nombre y el sitio web de una empresa por la que preguntas, solo para responder a esa petición.
  • Durante cuánto tiempo. Solo mientras se lee una tarjeta, se escribe un resumen o se lee el sitio web de una empresa. Nuestro servidor no guarda ninguna copia de la foto ni de los datos una vez que ha respondido. Anthropic los conserva durante un tiempo limitado según su propia política de conservación de datos, como explica nuestra política de privacidad.
  • Confidencialidad. ExpoCards lo gestiona una sola persona, que mantiene la confidencialidad de lo que se trata. Cualquiera que llegue a trabajar en ello con nosotros quedará obligado a lo mismo.
  • Seguridad. Las fotos y los datos viajan solo por conexiones cifradas, y nuestro servidor no guarda ni unas ni otros. Tu lista de contactos se queda en tu dispositivo, salvo que la exportes, la compartas con un equipo (apartado 5a: cifrada en el teléfono, con una clave que no tenemos) o actives tu propia base de datos.
  • Subencargados. Vercel aloja nuestro servicio de escaneo, y todas las fotos pasan por él. Anthropic lee la foto con su IA Claude, y escribe los resúmenes y lee los sitios web de empresas del apartado 5b. Upstash guarda los contadores anónimos de escaneos y los registros de compras, nunca datos de tarjetas de forma que pueda leerlos: para Equipos guarda además la lista cifrada de cada equipo (apartado 5a). Stripe cobra cualquier pago hecho en nuestra web o en la app de Android, y nunca ve datos de tarjetas. Vercel y Anthropic pueden tratar la foto fuera del Reino Unido y del EEE, incluso en Estados Unidos, con las condiciones de tratamiento de datos y las garantías de transferencia que cada uno ofrece a sus clientes. Indicaremos en esta página cualquier subencargado nuevo o sustituto antes de que empiece, y puedes oponerte escribiéndonos; si no podemos resolver tu objeción, puedes dejar de usar el servicio.
  • Ayuda. Te ayudamos, en la medida en que razonablemente podamos, a atender a las personas que pidan ver, corregir o borrar sus datos, y con tus obligaciones de seguridad, de notificación de brechas y de evaluación de impacto. No guardamos datos de tarjetas que podamos leer, así que la mayoría de las solicitudes se atienden desde los contactos de tu dispositivo.
  • Supresión. Cuando dejes de usar el servicio no hay datos de tarjetas que devolver: no guardamos ninguno que podamos leer. La copia cifrada de un equipo se borra como indica el apartado 5a. Si nos lo pides, borramos los contadores anónimos de escaneos de tu identificador de cuenta.
  • Brechas de seguridad. Si tenemos conocimiento de una brecha de datos personales que afecte a datos de tarjetas que tratamos por ti, te lo comunicaremos sin dilación indebida: en esta página, y por correo electrónico si nos has escrito.
  • Demostrar el cumplimiento. Respondemos por escrito a cualquier pregunta razonable sobre cómo cumplimos estas condiciones.

Fotografía solo tarjetas de visita y material de contacto similar. No uses ExpoCards para nada ilícito ni subas imágenes que no tengas derecho a usar. ExpoCards es una herramienta profesional y no está dirigida a menores.

4. Revisa lo que lee

Las tarjetas las lee automáticamente un modelo de IA, y el resultado puede contener errores: un dígito equivocado en un teléfono, un nombre mal separado de los apellidos. ExpoCards te muestra cada campo junto a la foto para que puedas revisarlo y corregirlo antes de guardar. Hazlo, por favor. No podemos garantizar que una lectura sea exacta o completa.

5. Tus contactos se guardan en tu dispositivo

Los contactos y las fotos de las tarjetas se guardan en tu dispositivo. Si usas Equipos (apartado 5a), los datos de los contactos de la lista de tu equipo se guardan también en nuestro servidor, cifrados con una clave que no tenemos. Si activas tu propia base de datos (solo en la app web, Settings → Advanced), también se copian a un proyecto de Supabase que es tuyo y del que respondes tú. No tenemos ninguna copia que podamos leer, así que no podemos recuperar tus contactos si pierdes el dispositivo, se desinstala la app o se borran los datos del sitio en el navegador. Usa «Download backup» con regularidad.

5a. Equipos

Con Equipos, los teléfonos de un stand comparten una sola lista de contactos. Es opcional, y no se comparte nada hasta que creas un equipo o te unes a uno.

  • Quién crea un equipo. Un equipo se crea para una organización, como la empresa titular del stand. Al marcar «I’m setting this up for my organisation» (lo creo para mi organización) confirmas que puedes aceptar estas condiciones en su nombre, y las aceptas por ella, incluidas las condiciones de tratamiento de datos que siguen.
  • Qué se comparte. Cada contacto de la lista del equipo (sus datos, notas, etiqueta del evento y «Asignar a») y el nombre que elige cada miembro llegan a todos los teléfonos del equipo. Las fotos de las tarjetas no se comparten.
  • Invitaciones. Cualquiera que tenga una invitación vigente, como código o como enlace, puede unirse y leer la lista. Una invitación vale 24 horas y para un máximo de 10 personas; una invitación nueva anula la anterior. Comparte las invitaciones solo con compañeros. Cualquier miembro puede quitar cualquier teléfono; el teléfono quitado conserva lo que ya tiene.
  • Cifrado. Los contactos se cifran en el teléfono, con una clave que solo tienen los teléfonos del equipo, antes de llegar a nuestro servidor. Guardamos esa copia cifrada para que los teléfonos se pongan al día; no tenemos la clave y no podemos leerla. Si se pierden todos los teléfonos de un equipo, no podemos recuperar la lista.
  • Límites. Hasta 10 teléfonos por equipo, un equipo en cada teléfono y un límite al número de cambios compartidos que puede guardar un equipo.
  • Salir y eliminar. Cualquier miembro puede salir, o eliminar el equipo para todos, lo que borra nuestra copia en ese momento. Un equipo que nadie usa durante 90 días se elimina automáticamente. Nada de esto borra los contactos que ya hay en un teléfono. Un contacto eliminado en un equipo sigue en la copia cifrada hasta que se elimina el equipo o caduca.
  • Disponibilidad. Podemos pausar o desactivar Equipos, por ejemplo durante una incidencia. Tus contactos siguen en cada teléfono y exportar siempre funciona.

Condiciones de tratamiento de datos de Equipos

Para la lista de un equipo, la organización es la responsable del tratamiento y nosotros somos su encargado. Estas condiciones son el contrato que exige el artículo 28 del RGPD de la UE y del RGPD del Reino Unido, aceptado en formato electrónico. Nos comprometemos a:

  • tratar la copia cifrada solo para guardarla y pasarla entre los teléfonos del equipo, siguiendo las instrucciones de la organización, que son estas condiciones y su uso de Equipos;
  • garantizar que quien pueda acceder a ella esté obligado a la confidencialidad;
  • protegerla como se describe arriba: cifrado en el teléfono con una clave que nunca tenemos, tokens de dispositivo e invitaciones guardados solo como resúmenes criptográficos, y conexiones cifradas;
  • usar como subencargados a Vercel (alojamiento) y Upstash (la base de datos). Upstash guarda la copia en la región que indica nuestra política de privacidad. Cuando Vercel o Upstash la tratan fuera del Reino Unido y del EEE, incluso en Estados Unidos, lo hacen con las condiciones de tratamiento de datos y las garantías de transferencia que cada uno ofrece a sus clientes. Indicaremos en esta página cualquier subencargado nuevo o sustituto antes de que empiece, para que la organización pueda oponerse o eliminar el equipo;
  • ayudar a la organización, en lo que podamos, a atender a las personas de sus tarjetas; como no podemos leer la copia, lo hace desde sus propios teléfonos;
  • informar a la organización sin dilación indebida de cualquier violación de la seguridad de los datos que afecte a la copia: en esta página, y por correo electrónico si nos ha escrito;
  • borrar la copia al eliminarse el equipo, o 90 días después de su último uso;
  • responder por escrito a cualquier pregunta razonable sobre cómo cumplimos estas obligaciones, para que la organización pueda demostrar que se cumplen.

5b. Resúmenes con IA y «About their company»

«Summarise notes» (resumir notas), «Today’s leads» (los contactos de hoy) y «About their company» (sobre su empresa) son opcionales. Cada una se pone en marcha solo cuando la tocas, necesita conexión y envía solo lo que nuestra política de privacidad indica para ella: nunca fotos de tarjetas, direcciones de correo ni teléfonos. Lo que escriben se guarda en tu dispositivo, con el contacto.

  • Revisa lo que dicen. Los resúmenes y «About their company» los escribe un modelo de IA. Un resumen puede pasar por alto o entender mal algo de tus notas. «About their company» repite lo que dice el sitio web de la propia empresa, que puede estar desactualizado o incompleto. Revísalos antes de fiarte.
  • La empresa, nunca la persona. «About their company» envía solo el nombre de la empresa y la dirección de su sitio web, y lee una página de ese sitio. No busca información sobre nadie. Usa lo que te diga solo para hacer seguimiento del contacto que te dio su tarjeta; a lo que guardes se le aplica el apartado 3.
  • Lo que consume. Cada ayuda usa escaneos de tu cupo: el número que la app muestra en su botón, y antes de tu primer resumen o tu primer «About their company». Un resumen o el resumen del día los consume cuando está escrito; «About their company», cuando se ha leído el sitio web de la empresa, aunque diga poco. Una ayuda que falla o se rechaza, o un sitio web que no se puede leer, no consume nada. Las tres tienen límites diarios en cada dispositivo, sea cual sea tu plan.
  • Disponibilidad. Podemos desactivar estas ayudas, o cambiar sus límites o los escaneos que usan, en cualquier momento; un cambio nunca se aplica a un resumen o una descripción de empresa ya hechos. Lo que ya han escrito se queda en tu dispositivo.

6. Los escaneos y la compra de más

Cada lectura correcta consume un escaneo. El reverso de una tarjeta es una segunda lectura, y una lectura fallida no cuenta. ExpoCards incluye escaneos gratuitos cada mes: 10 en el mes natural de tu primer escaneo y, después, 5 cada mes. En «Settings» (ajustes) se ve cuántos quedan. Cuando se agotan, las fotos nuevas esperan en la cola de tu dispositivo y se leen cuando vuelve a haber escaneos disponibles. Las ayudas de IA (apartado 5b) usan los escaneos que la app muestra en sus botones. Unos límites automáticos de frecuencia de peticiones protegen el servicio frente a abusos.

Los límites solo afectan a los escaneos nuevos. Ver, editar, buscar y exportar los contactos que ya tienes nunca se limita y nunca se cobra. No reduciremos el cupo gratuito que se te aplica ni te quitaremos escaneos que ya tengas.

En la app de iPhone puedes comprar paquetes de escaneos de pago único, que no caducan. El App Store muestra el precio en tu moneda y Apple cobra el pago a través de tu cuenta de Apple, según las condiciones de Apple. Nada se renueva por sí solo. La versión web, y la app de Android descargada desde nuestra web, ofrecen solo los escaneos gratuitos; una compra hecha allí antes conserva estas condiciones. Un pase de evento comprado allí da hasta 3.000 escaneos (uso razonable) durante el número de días indicado, a contar desde el momento de la compra; cuando ha hecho sus 3.000 escaneos, se sigue escaneando con tus escaneos acumulados y después con tu cupo gratuito, como si no hubiera pase. Esos pagos los gestionó Stripe en sus propias páginas, con el IVA incluido cuando correspondía; si necesitas una factura de alguno, escríbenos. Nosotros nunca vemos ni guardamos los datos de tu tarjeta bancaria.

Lo que compras pertenece al identificador anónimo de cuenta que guarda el navegador o la app en que hiciste la compra. No hay registro, así que una compra no pasa por sí sola a otro navegador o dispositivo, y borrar los datos del sitio en ese navegador, eliminar la app o usar «Erase all data» elimina el identificador. Si necesitas que traslademos una compra, escríbenos antes con el identificador («Settings», apartado «About») o con el recibo del pago.

Reembolsos. Si cambias de opinión en los 14 días siguientes a la compra, dínoslo: te devolvemos el importe íntegro si no has usado lo comprado, o la parte no usada de un paquete de escaneos si ya lo has empezado. Los reembolsos se hacen al mismo medio de pago que utilizaste. Las compras hechas en la app de iPhone las reembolsa Apple: solicítalo a Apple en reportaproblem.apple.com.

Si eres consumidor en el Reino Unido o en la UE, normalmente tienes derecho por ley a desistir de una compra en línea en un plazo de 14 días. Si usas escaneos durante ese plazo, podemos quedarnos con un importe proporcional a lo que hayas usado. Nada de lo dicho en este apartado afecta a ese derecho, ni a tus derechos si lo que te hemos suministrado es defectuoso o no se ajusta a lo descrito.

7. Disponibilidad y cambios

El escaneo depende de internet, de nuestro proveedor de alojamiento y de Anthropic. Trabajamos para que funcione siempre, pero no podemos garantizar que esté disponible en todo momento ni libre de fallos. Si el escaneo no está disponible, tus fotos esperan en la cola y todo lo que ya está en tu dispositivo sigue funcionando.

Podemos cambiar, mejorar o retirar funciones. Si alguna vez retiramos por completo el servicio de escaneo, lo avisaremos en este sitio web con antelación siempre que sea razonablemente posible, los contactos de tu dispositivo seguirán siendo tuyos y exportables, y te reembolsaremos los escaneos de pago y la parte no disfrutada de cualquier pase de evento que no hayas podido usar.

Podemos actualizar estas condiciones. La versión vigente y su fecha están siempre en esta página. Un cambio nunca te quitará escaneos que ya hayas pagado.

Podemos suspender o cancelar el acceso al servicio de escaneo de un identificador de cuenta que se use para incumplir estas condiciones. Si lo hacemos, los contactos de tu dispositivo no se ven afectados.

8. Nuestra responsabilidad

Lo que nunca excluimos. Nada de lo dispuesto en estas condiciones limita ni excluye nuestra responsabilidad por muerte o lesiones causadas por nuestra negligencia, por fraude o declaraciones fraudulentas, ni por cualquier otra cosa que la ley no nos permita limitar o excluir. Si eres consumidor, nada de lo dispuesto en estas condiciones afecta a tus derechos legales, incluido el derecho que te reconoce la Consumer Rights Act 2015 británica a que los contenidos y servicios digitales sean de calidad satisfactoria, adecuados para su finalidad y conformes con su descripción.

Si eres consumidor. Si un contenido digital defectuoso que te hayamos suministrado daña un dispositivo o un contenido digital tuyo, y eso ha ocurrido porque no actuamos con el cuidado y la diligencia razonables, repararemos el daño o te indemnizaremos. Respondemos de las pérdidas o daños que sean una consecuencia previsible de que incumplamos estas condiciones o de que no actuemos con el cuidado y la diligencia razonables. No respondemos de las pérdidas que no fueran previsibles, ni de las que podrías haber evitado razonablemente, por ejemplo revisando una lectura antes de fiarte de ella o haciendo una copia de seguridad.

Si usas ExpoCards con fines profesionales. Sin perjuicio de «Lo que nunca excluimos», no respondemos del lucro cesante, de la pérdida de negocio o de contratos, de la interrupción de la actividad ni de los daños indirectos o consecuenciales, y nuestra responsabilidad total frente a ti por todas las reclamaciones se limita a la mayor de estas dos cantidades: 100 £ o el importe que nos hayas pagado en los 12 meses anteriores a la reclamación.

9. Legislación aplicable y conflictos

Estas condiciones se rigen por el derecho de Inglaterra y Gales, y los tribunales de Inglaterra y Gales tienen jurisdicción no exclusiva. Si eres consumidor y vives en Escocia, en Irlanda del Norte o fuera del Reino Unido, también puedes reclamar ante los tribunales del lugar donde vives, y conservas la protección de las normas imperativas de consumo de ese lugar.

Escríbenos primero, por favor. La mayoría de los problemas se resuelven por correo.

10. Otras condiciones

Si un tribunal declara que una parte de estas condiciones no es exigible, el resto sigue siendo aplicable. Si no ejercemos un derecho de inmediato, podemos seguir haciéndolo más adelante. Estas condiciones son entre tú y nosotros, y nadie más tiene derechos en virtud de ellas. Podemos ceder nuestros derechos y obligaciones a otra persona o empresa que se haga cargo de ExpoCards. Si eso ocurre, lo indicaremos en esta página, y no reducirá tus derechos.

Estas condiciones están redactadas en inglés. La versión en español es una traducción para tu comodidad. Si hay diferencias entre ambas, se aplica la versión inglesa, salvo cuando la ley de tu país reconozca al consumidor el derecho a acogerse a la versión en su propio idioma.
